Terms of Service - End Users License Agreement
RAGNARÖK ONLINE SOFTWARE LICENSE AGREEMENT
TO CREATE YOUR USER ACCOUNT (AS DEFINED BELOW) YOU MUST AGREE AND ACCEPT THESE RULES.
BEFORE PROCEEDING WITH YOUR REGISTRATION, GRAVITY INTERACTIVE INC. STRONGLY RECOMMENDS THAT THE USER CAREFULLY READ THIS DOCUMENT. YOU MUST BE 18 YEARS OLD OR OLDER TO ENTER INTO THIS LICENSE AGREEMENT.
BY COMPLETING THE REGISTRATION PROCESS ON THE PLATFORM, THE USER EXPRESSLY AND IRREVOCABLY ACCEPTS ALL THE TERMS, CLAUSES AND CONDITIONS OF THIS RAGNAROK ONLINE SOFTWARE LICENSE AGREEMENT.

RAGNARÖK ONLINE SOFTWARE LICENSE AGREEMENT
I. The Parties
This Ragnarök Software License Agreement (hereinafter referred to as the "License Agreement") is entered into by and between Gravity Interactive Inc. ("GRAVITY"), a corporation duly organized and existing under the laws of the United States of America (USA), with its principal place of business at 7001 Village Drive Suite 150 Buena Park, CA 90621; and the User (as defined below).
For the purposes of this agreement, a User is the person identified when filling out the "REGISTRATION" form ("User"), available on the Website WWW.GNJOYLATAM.COM and other websites advertised by the company ("Site"). The information provided by the User during the registration is personal, non-transferable and presumed to be true and accurate for all legal purposes and effects, with the User being exclusively and directly responsible for such veracity.
II. General terms and conditions
1. Basic Requirements
1.1. Upon acceptance of this License Agreement, for any reason, GRAVITY will, in accordance with the law, grant the User a personal, non-exclusive, non-transferable and non-sub-licensable license to use the game RAGNARÖK ONLINE ("Game") within the country the User is located (“Territory”), for an indefinite period (“License”).
1.2. The License is granted under the terms of this License Agreement, and the User may only use the License in accordance with the terms set forth herein. This License Agreement does not assign or transfer any title or ownership over the Game or its content to the User.
1.3. The User must check whether he/she meets the necessary requirements to access and use the Game, which are provided in clause 7 of this License Agreement.
1.4. The Game will be made available to the User by GRAVITY on the Website. The User acknowledges and agrees that it may be necessary to update the Game from time to time at GRAVITY's sole discretion.
2. Age classification
2.1. You must be 18 years old or older to register and use the Game.
2.2. Any User Account (defined below) created by a user younger than 18 years of age, even with the representation or assistance of the User’s parent or guardian, will not be permitted to log-in to the game.
2.3. The registration of a User Account and the use of the Game involve the processing of personal data.
2.4. GRAVITY reserves the right to request, at any time, documents proving account ownership and that the user accessing the game is 18 or older. Failure to submit the documents will be considered a violation of the terms of this contract and will result in the blocking of the accounts of the users involved until the situation is regularized.
2.5. GRAVITY does not intentionally process the personal data of minors and encourages parents and legal guardians to guide children and adolescents not to share personal data online without supervision. Our Privacy Policy (https://member.gnjoylatam.com/support/terms/privacy) describes how we process User’s personal data.
3. User Account Registration
3.1. To register and use the Game, the User must create a GnJoy account ("User Account"), and a password ("Password"), which will be the personal and non-transferable identification of each User Account. The User must always register their User Account associated with a valid and accessible electronic address ("e-mail").
3.1.1 Disposable or Temporary e-mails are not permitted and any User Accounts detected using these services will be blocked. E-mail aliasing is also not permitted, and if detected it may result in the Game Account being blocked. The creation of excessive accounts by the same individual, whether through different e-mail addresses, aliasing techniques, or other circumvention methods, is expressly prohibited. Accounts found to be in violation of this rule may be subject to suspension or permanent blocking.
3.2. The User must have a User Account in order to create a game account (“Game Account”). Each User Account permits the creation of one Game Account. The e-mail and password used to create the User Account serve as account login for both the User Account and Game Account. Additionally, the User must establish a 4-digit PIN (“PIN”) and activate Google OTP to access the game.
3.3. The User acknowledges and agrees that he/she is the only one who knows his Password and PIN and that he/she is solely responsible for protecting the Password and PIN from third parties. The User agrees that any access to their User Account using their Password and any access to their Game Account using their password, and PIN is considered to be authorized access, and the User is liable for any acts practiced through the User Account or Game Account.
3.4. Each User Account and associated Game Account are assigned a unique and individual identification number by the game service system.
4. User and Clan Identification
4.1. The User is not permitted to choose character name (“Character Name”) that is already in use. The User is not permitted to choose a character name that may be illegal, protected by intellectual property rights, obscene, considered inappropriate by GRAVITY, or that violates the laws of your Territory or the rights of third parties.
4.2. If GRAVITY identifies that the name does not comply with the above provisions, GRAVITY will apply the punishment and procedure in accordance with the game rules and punishment table published on the website.
4.3. The User will only be known and identified in the Game by means of his/her Character Name(s). Any disclosure of his/her true identity is the sole and exclusive responsibility of the User.
4.4. In order to ensure the smooth running of the Game, the User expressly authorizes GRAVITY to disclose his/her Character Name on the Website, for participation in events, promotions, competitions, etc.
4.5. The choice of the Clan name within the Game is subject to the same rules and restrictions set out in clause 4.1 above.
5. Taking care of Passwords and Accounts
5.1. The User must keep his/her Password and PIN strictly confidential and must not share them with any third party. If the User suspects or becomes aware that his/her Password and/or PIN has been disclosed to, discovered by, or otherwise compromised by any third party, he/she must immediately: (a) change the compromised Password and/or PIN through the Website; and (b) contact GRAVITY’s support center through the Website to report the incident. GRAVITY shall not be held liable under any circumstances for any loss, damage, theft, or unauthorized use arising from the disclosure or compromise of the User's Password, OTP, and/or PIN, whether such disclosure results from the User's negligence or any other cause.
5.2. The User agrees that the User Account and Game Account are individual and the User is solely responsible for all acts performed through his/her User Account and Game Account. GRAVITY is not responsible for any act performed by the User in the User Account and/or Game Account.
5.2.1. The User acknowledges and agrees that any individual accessing the User Account and/or Game Account using his/her Password and PIN is considered an authorized third party.
5.3. The User is responsible for any incident resulting from the disclosure of his/her Password and/or PIN to third parties - intentional or careless - and GRAVITY recommends that the User take some measures to protect the Password and/or PIN, such as, but not limited to:
a) do not write your Password and/or PIN on paper or logical files;
b) do not use passwords that are easily deciphered, such as: date of birth, license plate, etc.;
c) not lend or share the password with other Users;
d) change the password periodically;
e) enable Google 2 step verification for your access to the Game.
5.4. GRAVITY shall not be liable for any personal information that the User discloses to third parties, including his/her Username, Password and/or PIN. GRAVITY shall not be liable for any damages that the User may suffer as a result of having disclosed his/her personal information.
5.5. The User is aware that the processing of personal data will follow the provisions of GRAVITY's Privacy Policy. Any questions about privacy regulation, rights of data subjects or security incidents involving personal data should be addressed to GRAVITY's Data Protection Officer (DPO), whose contact information is available here (Certificate – Gravity Interactive INC - DPO Oficial ) and in the Privacy Policy.
6. Information Provided
6.1. It is the User's responsibility to provide true, accurate and correct information when registering, as well as to keep it updated. This includes a valid and accessible email address.
6.2 GRAVITY reserves the right not to change the data that proves ownership of the User’s Game Account, namely: First and last names and date of birth. Any corrections to this information may be made, as long as they do not imply a change in ownership of the Game Account.
6.3. It is the exclusive and direct responsibility of the User to provide accurate and true information during registration. GRAVITY presumes the personal data provided to be valid, and the use of fictious personal information (name, birthdate) may make it impossible to provide adequate support to the User.
7. Essential Requirements
7.1. The essential requirements for using the Game are:
(i) being 18 years old or older;
(ii) completing the registration;
(iii) providing a valid electronic e-mail address;
(iv) creating a User Account;
(v) creating a Game Account;
(vi) using an installation (hardware and software) compatible with the technical configurations informed by GRAVITY on the Website;
(vii) installing the Game on the computer;
(viii) having Internet access compatible with the technical configurations provided by GRAVITY on the Website;
(ix) unlocking systems that prevent the User from accessing the Game.
(x) activating Google One Time Password (OTP) for Game Account
8. Valid Electronic Address ("e-mail")
8.1. It is essential for the registration of the User Account and for access to the Game itself that the User has a valid e-mail. GRAVITY recommends that the User ensures that his/her e-mail box is able to receive messages from GRAVITY.
8.2. The User agrees that GRAVITY may use the e-mail address provided to send information about the Game, general information or any other notifications that may be necessary, including any updates to this License Agreement.
8.3. The User must validate his/her email through the Website to demonstrate that the e-mail associated with the User’s Game Account is correct and that the User has access to the email before the User attempts to obtain in-game currency.
8.4. To access the game, the User must validate his/her e-mail address through the Website to enable Google OTP authentication. The valid e-mail may be used to contact the User for support purposes, including password recovery, changes to personal data, and confirmation of account ownership. The User is solely responsible for providing and maintaining a valid and accurate e-mail address at all times.
9. User Access to the Internet
9.1. GRAVITY does not provide Internet access, and the User is responsible for all costs associated with their Internet connection.
10. From Access Servers to Ragnarök
10.1. To access the Game, the User must choose one of the available access servers. Virtual items, characters and/or experience (“XP”) obtained in the game cannot be transferred between servers.
10.2. All the servers offered to users are free to access. In the case of eventual differences, server specifications will be provided by GRAVITY on the Website.
10.3. GRAVITY reserves the right to modify the conditions of access to the servers, previously disclosing information and clarifications on the subject to the User.
11. Acquisition of special items
11.1 GRAVITY makes available to Users special items ("Special Items") that can be obtained through in-game currencies ("JoyCoins" and “JoyPoints”). JoyCoins and JoyPoints can only be used for in-game purchases and for gaming purposes. Therefore, they do not constitute electronic, or fiat currency issued by a government entity, and they cannot be freely transferred – they can only be transferred in-game.
11.2. The User may purchase JoyCoins through the payment methods made available by GRAVITY’s designated payment processors.
11.3. The availability of specific payment methods, including but not limited to credit cards, digital wallets, bank transfers, or other electronic payment solutions, may vary depending on the payment processor, the User’s location, and other relevant factors.
11.4. All transactions for JoyCoin purchases are processed through third-party payment service providers, and GRAVITY does not store or process the User’s payment information directly. The terms and conditions of the selected payment processor will govern the processing of payments, and the User must comply with those terms when completing a purchase.
11.5. The User declares to be aware that the following are not permitted:
(i) the exchange and/or trading of JoyCoins or any other virtual items between Users involving real-world money or values;
(ii) the acquisition of virtual items and/or components of the Game Software outside the conditions established in this License Agreement (i.e. purchase of JoyCoins and/or virtual items with third parties outside the accredited network);
(iii) the exchange and/or selling of User Account or Game Account whether through JoyCoin or any other currency and/or product.
11.5.1 Failure to comply with this clause will be considered a violation of the terms of this License Agreement and may result in the permanent blocking of the User Account and Game Account by GRAVITY. Any questions regarding the accredited network or the regularity of the transaction should be directed to the Customer Support Center ( https://gravityus.freshdesk.com/support/home ).
11.6. GRAVITY reserves the right to modify the payment processors and applicable payment methods, set limitations on purchases, or apply additional verification requirements to ensure the security of transactions and compliance with applicable laws and regulations and authorized credit cards at any time, disclosing such information on the Website.
11.7. GRAVITY is not responsible for failed, delayed, or incomplete transactions resulting from issues with third-party payment processors, including but not limited to technical failures, insufficient funds, transaction reversals, or delays in processing. Any and all problems with the payment must be immediately communicated by the User to the respective payment processor’s support service.
11.8. The purchase of JoyCoins is prohibited for any User under the age of 18. By completing a purchase, the User confirms that he/she has complied with such obligation. GRAVITY is not liable for unauthorized purchases made by minors, whether through their own accounts or using the payment details of a parent or legal guardian..
11.9. Upon completion of purchases, JoyCoin will be made available in the Game Account indicated by the User at the time of purchase. JoyCoins are linked to the indicated Game Account and are non-transferable.
11.10. User is fully aware of and agrees that by acquiring JoyCoins or any virtual items (even if using real currency) it is only acquiring a license to use features offered within the Game. The acquisition of JoyCoins and virtual items does not transfer ownership or title over any asset, goods or services. Further, User is fully aware that once the JoyCoins or any characters and/or game items are acquired in the Game, it is not possible to sell such JoyCoins or characters and/or game items for real currency. Hence, once the JoyCoins, characters and/or game items are purchased, the User will no longer be able to sell them for real currency or by anyway convert it into real currency in the future.
12. Interruption of Services
12.1. GRAVITY reserves the right to interrupt access to the Game periodically on a regularly scheduled basis with prior notice to Users, to carry out any type of maintenance necessary for the smooth running of the game.
12.2. GRAVITY reserves the right to interrupt access to the Game, regardless of prior notice to Users, whenever, as a matter of urgency, corrective intervention is necessary.
12.3. The User agrees that, in addition to the preventive and/or corrective maintenance hypotheses provided for above, access to the Website and the Game may also be interrupted due to Force Majeure, Act of God and any other reason beyond the control and will of GRAVITY. GRAVITY is not responsible for the interruption of the Service, delays or failures resulting from any causes beyond its control.
12.4. GRAVITY also reserves the right to interrupt access to the Game, without notice, if you fail to comply with any of the terms of this License Agreement.
13. Game Security System Update
13.1. GRAVITY will use its best technical efforts to carry out all assessments and preventive and corrective measures to protect the integrity of its services.
14. Unacceptable Conduct defined by the Code of Conduct
14.1. In order to ensure that Users can enjoy the Game, GRAVITY will not allow Users to engage in Unacceptable Conduct (https://member.gnjoylatam.com/support/terms/account) and, when this occurs, GRAVITY reserves the right to apply the corresponding punishment in accordance with the Punishment Table (https://member.gnjoylatam.com/support/terms/restrict) and the list of Unacceptable Conduct in the Game. In order to maintain the level of loyalty among Game participants, GRAVITY requests that Users collaborate in reporting the occurrence of Unacceptable Conduct, which will be subject to sanctions by GRAVITY. 14.2. Unacceptable Conduct and the Punishment Table are listed, as an example, on the Website. GRAVITY may adapt or include new Unacceptable Conduct, at any time, always for the benefit of the Game. Any adjustments or additions will be disclosed to Users through the Website. It is the User's responsibility to keep themselves informed about updates to the Code of Conduct for the Game, and the Forum.
14.3. The User shall fully respect the rules of the Code of Conduct of the Game and Game Forum that are available on the Website and here. Failure to observe said rules shall result in the application of the respective punishment(s).
14.4. The User declares to be aware of and agree with the penalties provided for on the Website. Note that if the User uses the Game in connection with third-party websites, the User must review and abide by the third-party’s terms of service and applicable policies. GRAVITY will not be responsible for any penalties applied to the User by third parties.
14.5 The use of any illegal programs, systems, routines, computers or automated devices with the Game or GRAVITY Websites is strictly prohibited and may result in legal action under applicable regulations from your Territory and, where applicable, the Computer Fraud and Abuse Act. Section 1030) of the United States federal government. Failure to comply with these rules may result in legal action under the applicable law, with the respective and appropriate punitive damages.
14.6. The complete list of Unacceptable Conduct must be reviewed by the User on the Website whenever the User uses the Game. However, User should be aware that the Game must not be used to:
14.6.1. Violate any law (including without limitation laws related to torts, contracts, patents, trademarks, trade secrets, copyrights, defamation, obscenity, pornography, rights of publicity or other rights) or encourage or provide instructions to another to do so;
14.6.2. Post any content that contains falsehoods or misrepresentations that could damage the Game, GRAVITY, or any third party;
14.6.3. Post any content that may endanger life or lead to physical harm or has been expressly prohibited by applicable law (including streaming while driving, sleeping etc.), involve physical trauma, use or abuse of drugs and alcohol, any political or extremist advertisements, sexual harassment or sexual objectification;
14.6.4. Post any content that harm minors in any way;
14.6.5. Impersonate any person or entity;
14.6.6. Post any content that is defamatory, libelous, obscene, pornographic, pedophilic, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, is racially or ethnically objectionable, relates to or encourages money laundering or gambling, or otherwise is inconsistent with or contrary to the laws in force;
14.6.7. Post any content containing unsolicited or unauthorized advertising, promotional materials, spam, junk mail, chain letters, pyramid schemes, scams, or any other form of unauthorized solicitation;
14.6.8. Post any content containing copyrighted materials, or materials protected by other intellectual property laws, that you do not own or for which you have not obtained all necessary written permissions and releases;
14.6.9. Deploy or use programs, software or applications designed to harm, interfere with the operation of, or access in an unauthorized manner, services, networks, servers, or other infrastructure;
14.6.10. Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Game;
14.6.11. Obtain or attempt to access or otherwise obtain any content or information through any means not intentionally made available or provided through standard use of the Game;
14.6.12. Exploit errors in design, features which are not documented and/or bugs to gain access that would otherwise not be available;
14.6.13. Use any robot, spider, LLM or other automatic device, process or means to access the Game for any purpose, including monitoring or copying any of the material on the Game or Website without GRAVITY’s prior written consent;
14.6.14. Introduce or upload any viruses, Trojan horses, worms, logic bombs, time bombs, cancelbots, corrupted files or any other similar software, program or material which is malicious or technologically harmful or that may damage the operation of another’s property or of the Game.
15. GRAVITY's Rights in the Face of Unacceptable Conduct
15.1. GRAVITY shall have the right to review and remove from the Website all content, messages or other communications that it considers to be resulting from Unacceptable Conduct, and shall decide what is considered offensive, illegal, or entails the usurpation of rights, harm or threaten the safety of another User.
15.2. In the event of any Unacceptable Conduct being practiced, in addition to applying the corresponding penalties to the User, GRAVITY may disclose, to the extent permitted by the laws of your Territory, to the police, administrative or judicial authorities the registration data of Users who have practiced any act that implies a violation of your Territory laws or the rights of interested third parties.
16. Punishment of the User
16.1. The punishment of the User for carrying out Unacceptable Conduct within the Game and Forum may consist of:
16.1.1. Warning to the offender, in accordance with Unacceptable Conduct;
16.1.2. Suspension of the User Account or Game Account for a specific period of time, disabling access to the Game;
16.1.3. Termination of virtual goods (items, zeny and Special Items) that are in the possession of the User, Game Account or User Account at the time of application of the punishment, regardless of their true or alleged ownership;
16.1.4. Cancellation of the Game Account, in the cases provided for in the Penalties Table in force;
16.1.5 Cancellation of the User Account, and Game Accounts associated with the User Account in the event of financial fraud, or in cases where they are in violation of the rules of conduct published on the Website.
16.2. The punishments applied by GRAVITY are based on the User's violation of any of the rules set out in this License Agreement, the Game's rules of conduct and/or the Forum's rules.
17. Contract Termination:
17.1. Contract termination with cancellation of the “User Account” and “Game Account” before the acquired JoyCoins have ended and/or been consumed will occur in the following cases and conditions:
17.1.1. By withdrawal of the User, i.e., when the User, at any time, requests the termination of the License Agreement.
17.1.2 For the practice of Unacceptable Conduct, i.e., when the User violates any Rule of Conduct of the Game and/or the Forum whose punishment results in the suspension of the "Game Account", in accordance with the Table of Punishments. In the event of suspension of a Game Account, GRAVITY may terminate User Accounts and related Game Accounts if it is determined that they are also in violation of the Game Rules of Conduct.
17.1.2.1. In the event of cancellation of the "User Account" resulting from violation of the Rules of Conduct of the Game and/or the Forum on the Website, by the User, there will be no refund of amounts not yet consumed.
17.2. JoyCoins, characters and/or game items and/or any other virtual elements will not be refunded to the User upon any termination of this License Agreement, regardless of the reasons that lead to the termination of the relationship between the User and GRAVITY.
18. Closing of Operations:
18.1. GRAVITY has the right to terminate the operations of the Game by government or judicial decision that determines its termination and/or for reasons of force majeure, beyond the will and control of GRAVITY.
18.2. GRAVITY reserves the right to terminate the operations of the Game upon a notice 30 days in advance to the User and will guarantee the User the right to consume the remaining JoyCoins or vitual items during the period prior to the termination of the operations of the Game.
19. Intellectual Property
19.1. The Game, together with the logos, brands, insignia, symbols, distinctive signs, documentation and any other materials related to these computer programs, constitute, as the case may be, copyrights, trade secrets, and/or intellectual property rights of GRAVITY or its licensors, such rights being protected by national and international legislation applicable to intellectual property, copyrights and business and industrial secrets. Under no circumstances will these assets and rights be transferred to the User, whether as a result of the License or in view of its use.
19.2. Distribution of the Game is the exclusive property of GRAVITY and its official partners. The User and third parties are expressly prohibited, under penalty of law, from: selling; renting; leasing; assigning; donating; lending; reproducing; adapting; translating; providing as collateral; allowing seizure; offering as a loan for use; transferring; transmitting; allowing shared use; making available for access or use by third parties, whether online or otherwise; performing, granting permission to perform or contributing to the performance of decompilation, reengineering, reverse engineering, modification of characteristics, expansion, alteration, merging or incorporation into any other programs or systems; finally, alienating, in whole or in part, temporarily or permanently, free of charge or for a fee, under any form, form or title, the Game.
19.3. Whenever you create, develop, modify or contribute any type of content to the Game and/or to the Website (“User Generated Content”) or provide GRAVITY with any kind of feedback (“Feedback”), you give GRAVITY a worldwide, non-exclusive, fully paid, royalty-free, sublicensable, transferable, and assignable license to display, use, copy, import, store, modify, reproduce, create derivative works of, transfer and distribute such User Generated Content and Feedback. This permission is perpetual and irrevocable and applies to any media, platform, or channel in connection with the Game.
19.4. The User shall be solely responsible for his User Generated Content and the consequences of posting, uploading, publishing, transmitting or otherwise making available his User Generated Content on the Game or Website. GRAVITY is not responsible, or liable to any third party, for the content or accuracy of any User Generated Content made available by the User. GRAVITY does not control the User Generated Content provided or contributed by the User and GRAVITY does not make any guarantee whatsoever related to User Generated Content submitted or contributed by the User. Although GRAVITY sometimes reviews User Generated Content provided or contributed by the User, GRAVITY is not obligated to do so. Under no circumstances shall GRAVITY be liable or responsible in any way for any claim related to User Generated Content provided or contributed by the User.
20. GRAVITY’s Liability
20.1. User agrees that GRAVITY is not responsible for threats, defamatory, obscene, offensive or illegal content or conduct of third parties or any User, violation of rights, including intellectual property rights.
20.2. GRAVITY takes all necessary measures to maintain a good level of cordiality and decorum among its users in the Game environment and, under no circumstances will it be held responsible for any acts contrary to such policy carried out by Users or third parties.
20.3 LIMITATIONS OF LIABILITY.
20.3.1. TO THE EXTENT NOT PROHIBITED IN YOUR TERRITORY, USER AGREES THAT GRAVITY SHALL NOT ASSUME OR HAVE ANY LIABILITY FOR ANY ACTIONS OF GRAVITY OR ITS CONTENT PROVIDERS OR OTHER LICENSORS WITH RESPECT TO THE CONDUCT, COMMUNICATION OR CONTENT OF THE GAME. GRAVITY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION OR ANY OTHER PECUNIARY DAMAGES) IN CONNECTION WITH THE SERVICES OR PRODUCTS OFFERED BY GRAVITY. GRAVITY'S ENTIRE LIABILITY AND REMEDIES WITH RESPECT TO THE USE OF ITS SERVICES AND ALL CONTENT AND SOFTWARE DEVELOPED BY OR FOR GRAVITY SERVICES THAT PROVE TO BE DEFECTIVE USING A MEDIA CHOSEN BY GRAVITY SERVICES SHALL BE LIMITED TO AN AMOUNT EQUAL TO THE TOTAL AMOUNT PAID BY THE USER FOR THE DEFECTIVE SERVICE MINUS AN AMOUNT EQUAL TO THE VALUE OF THE SERVICE FOR THE TIME IT OPERATED CORRECTLY. GRAVITY'S LIABILITY TO THE USER FOR ANY AND ALL BREACHES OF THIS LICENSE AGREEMENT IS LIMITED ONLY TO THE TOTAL AMOUNT OF JCOIN REMAINING IN THE USER'S ACCOUNT.
20.3.2. GIVEN THAT SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, GRAVITY'S LIABILITY MUST BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
21. Compensation
21.1. You agree to indemnify, defend and hold harmless GRAVITY and its subsidiaries, affiliates, respective directors, officers, employees, shareholders, agents, service provider clients, customers and subcontractors from and against any damages, claims, demands, costs or expenses (including reasonable legal fees) asserted by any third party due to or in connection with your conduct on the Game, violation of this License Agreement or violation of any other rights of another User. GRAVITY reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, which shall not excuse your indemnification obligations.
22. Disclaimer of Warranties
22.1. TO THE EXTENT NOT PROHIBITED BY THE LAWS OF YOUR TERRITORY, you expressly agree that the service and content are being provided “as is” and “as available,” and that you use the service at your own risk and responsibility. GRAVITY and all its official partners expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement of intellectual property or other violations of rights. GRAVITY and all its official partners do not guarantee that the service will meet your requirements or that the service will be uninterrupted, timely, secure or error-free. GRAVITY and all its official partners make no guarantee or promise as to the results that may be obtained from the use of the service, that the results obtained from such use will be reliable or accurate, or that the quality of any products, services, information or any material purchased or obtained by you through the service will meet your expectations. GRAVITY does not warrant that defects in its software will be corrected or that the websites or servers provided will be free of viruses or any other harmful components. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the Service is done voluntarily and at your own risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of any such material or data. No advice or information, whether oral or written, obtained from GRAVITY or any official partner, or through the services, will create any warranty not expressly stated in the License Agreement. You agree that GRAVITY shall not be liable for anything that occurs or results from accessing the GnJoy LATAM Service.
23. Medical Care
23.1. It is known that a very small percentage of individuals may experience epileptic seizures when exposed to certain test patterns such as flashing lights, certain types of noise, prolonged reading, sleep deprivation, fatigue, hypoglycemia (low blood sugar), etc. Exposure to certain test patterns with computer or video games may induce a seizure in these individuals. In addition, certain circumstances may induce symptoms of epilepsy even in people who have no history of epileptic seizures. If the User, or any member of his/her family, has epilepsy, consult his/her doctor before playing.
23.2. The User must IMMEDIATELY stop the Game and consult his/her doctor if he/she experiences symptoms such as absence seizures; distortions of perception, uncontrolled movements of a part of the body, sudden fear, nausea, distortions in hearing and/or vision or loss of consciousness.
24. General Provisions
24.1. This License Agreement, which must be interpreted in conjunction with the Website and Forum Rules of Conduct, Punishment Table, Account Policy and other documents pertinent to the Game, is the only instrument to govern the relationship between GRAVITY and the User, being that this document supersedes any prior instruments between GRAVITY and the User and will not prevail over any additional terms and conditions of which the User is notified by GRAVITY. GRAVITY may change this License Agreement at any time exclusively at its discretion, and said change will come into force upon its publication on the Website. Every time the User agrees to this License Agreement, they will be ratifying their broad and unrestricted acceptance of all its terms and conditions, as well as any changes that the License Agreement may receive.
24.2. In the event that any provision of this License Agreement is found to be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired. In such event, the provision found to be invalid, illegal or unenforceable shall be replaced by another that leads the parties to the same economic and legal result sought.
24.3. GRAVITY and the User acknowledge and declare that the failure to exercise or delay in exercising any right granted to them by this License Agreement or by law shall be deemed to be a mere liberality and shall not constitute novation or waiver of such rights or of the other clauses contained herein. The waiver, by either party, of any such rights shall be construed restrictively.
25. Violations
25.1 Please report any violations of the terms of the License Agreement to the responsible departments using the support system on the official website.
26. Limitations on Service Access Territories
26.1 GRAVITY officially notifies that it does not offer any services to European Users. If you are a European User, please do not attempt to access the Websites or attempt to play any games through any GRAVITY service. Furthermore, if you acquire new nationality, for any reason, and become a European User after using GRAVITY services, you must notify GRAVITY to terminate your User Account and access to GRAVITY services under the terms of this License Agreement.
27. Applicable Law and Jurisdiction
27.1. EXCEPT WHEN THE LAWS AND REGULATIONS APPLICABLE IN YOUR TERRITORY REQUIRE OTHERWISE, any and all controversies or disputes arising from this License Agreement shall be resolved exclusively and definitively by the Court of the defendant's domicile based on the laws of the United States of America.
